Proxacom is your distributor for used software. We re-license software through legally compliant transfers between companies. We offer companies cost-effective licenses according to their actual needs and activate capital tied up in unused software.
Unlike hardware, software is not subject to physical wear and tear. Furthermore, used software licenses generally do not differ significantly in functionality from the latest version. You can also still purchase desired updates from the manufacturer for used software. Therefore, you have no disadvantages compared to new acquisitions.
Proxacom transfers Microsoft volume licenses in a legally compliant manner. Microsoft volume licenses are transferred based on and in compliance with the European Software Directive, confirmed by several national supreme court decisions (2000) and the Court of Justice of the European Union (2012). Our transfers of used software licenses comply with the current international and German legal standard: "There is no bona fide acquisition of licenses".
The legal situation for Proxacom's transfer models is clear. We transfer used Microsoft volume licenses in a legally compliant manner. Volume licenses are transferred on the basis of the European Software Directive and applied national law, confirmed by judgments of the German Federal Court of Justice from the year 2000 and the Court of Justice of the European Union of July 3, 2012 (legally compliant).
As already mentioned, trading used software is permitted and legal following a supreme court ruling. Not even a software manufacturer can oppose this situation. Microsoft as a company is therefore not negatively opposed to trading used licenses, provided that the "specific conditions", i.e. the complete proof of the license chain, are fully met.

In a letter from its legal department in November 2015, Microsoft thus officially took a stance on the admissibility of the sale and use of used software.

With another official letter at the end of January 2018, Microsoft supported its customers and partners in being able to safely distinguish illegal offers from legally compliant used original software.

With regard to the standard international legal norm "There is no bona fide acquisition of licenses", all license transfers must be legally compliant. More than just an invoice, license lists, etc. are always required to prove the transfer. Proving the so-called "license chain" usually requires, for example in the case of volume licenses, the seamless documentation of all license transfers back to the initial acquirer of the licenses. This and other information required to prove a legally compliant transfer are part of the Proxacom transfer documentation.
Yes, we guarantee this. At Proxacom, you exclusively receive tested original goods with legally compliant licensing. By disclosing the complete license chain as well as reporting the license transfer to the manufacturer, Proxacom's customers are on the safe side.
According to the ruling of the European Court of Justice of July 3, 2012, trading used software is permitted in all countries of the European Union.
As Proxacom, we ensure that the customer receives all necessary information required for the purchase of used software without exception. The proof of the entire license chain from the initial licensee to the secondary user is clearly disclosed, documented and fully handed over.

  • Copies of the relevant Microsoft license agreements.

A data carrier is not included by default. However, upon request, we can create a data carrier for a small surcharge. This can be a CD, DVD or USB stick. It is also possible to obtain it via download.
This is one of the differences compared to purchasing high-priced new licenses. Licenses from the secondary market are rarely stored in the Microsoft VLSC portal. This is not due to the nature of used software, but rather not intended by Microsoft.
Yes, here too the customer is on the safe side. Used software is equally subject to the Microsoft policy for lifecycle security updates.
